Civil Litigation - Answer to the Complaint
Northern California Civil Litigation Information
An "Answer" to a Complaint typically contains a "general denial,"
which generally denies all of the allegations in the Complaint, and various
"affirmative defenses" which are legal theories to defeat or minimize the
damages sought in the Complaint, even if the plaintiff's allegations are true.
Typical affirmative defenses include: statute of limitations (the lawsuit was
filed too late), comparative fault of the plaintiff or others, and failure to
state a claim (meaning the alleged conduct, even if true, is not illegal).
