Civil Litigation - Enforcement of Judgment

The prevailing party is the "judgment creditor." The losing party
is the "judgment debtor." There are many different methods to enforce a money
judgment, from attaching the judgment debtor's real property to garnishing his
wages. If a judgment debtor will not pay a money judgment, the judgment
creditor can file and record (in the County Recorder's Office) an "Abstract of
Judgment" in each county where the judgment debtor owns real property, which in
effect becomes a lien on any property held by the judgment debtor in that
county. The judgment lien can be satisfied if and when the judgment debtor
sells the property and sufficient funds are in escrow to pay toward or satisfy
the judgment.
