Northern California Civil Litigation Information
Many cases involve matters which require specialized knowledge or
expertise but which are not necessarily legal matters. For example, most
attorneys do not have engineering or other scientific expertise regarding
issues which may be relevant to your lawsuit. Thus, your attorney may retain an
expert consultant whose job is to analyze certain evidence in reference to
their area of expertise and provide an "expert opinion" concerning a particular
matter involved in your lawsuit. For example, if you are a tradesman or other
contractor and a plaintiff alleges that your work is defective, you may need a
consultant who is an expert in your field of work in order to evaluate your
work and determine whether or not, in the consultant's opinion, your work met
the standard of care required for your particular trade or activity.
Attorneys often hire one or more "consultants" to help investigate
particular aspects of the case which may require specialized knowledge such as
medical issues, engineering issues and issues unique to certain professions and
businesses. Such consultants can also testify at trial concerning their
opinions on such issues, so long as the judge determines they have demonstrated
the requisite level of expertise in their particular field.
