Civil Litigation - Satisfaction of Judgment
Northern California Civil Litigation Information
Once a judgment is in place, the judgment must be "satisfied."
Satisfaction of Judgment is usually "stayed" if the Judgment is appealed. If
the defendant prevails and there is no appeal, the only judgment which needs to
be satisfied is whatever cost award has been assessed in the defendant's favor.
If the plaintiff prevails and there is no appeal, then the judgment is
satisfied by the defendant's payment of the judgment.
Once the losing party has paid the judgment, the prevailing party
should file a "Satisfaction of Judgment." If the losing party fails to pay the
judgment, then the prevailing party may take steps to enforce the judgment.
