Civil Litigation - Special Situations Temporary
Restraining Orders and Preliminary Injunctions
Northern California Civil Litigation Information
Resolving a dispute though civil litigation can take years. If
you need immediate relief, then you need to apply for a Temporary Restraining
Order (TRO) and Preliminary Injunction. For certain types of situations, such
as domestic violence for example, there are pre-printed forms you can obtain
online or possibly from the court which are somewhat self-explanatory, and you
may feel comfortable completing and filing the forms yourself.
In business or other more complex matters, you will probably need
to apply for a Temporary Restraining Order to get the immediate relief you
want. A Temporary Restraining Order is basically a temporary injunction.
Injunctions are court orders which usually prohibit one party from doing any
number of specific activities. There are also TROs and injunctions which
command a party to do something, but those are more rare and difficult to
obtain. Usually, an injunction stops something from happening. In business or
